License Agreement
IMPORTANT - READ CAREFULLY
This license statement and limited warranty constitutes a legal agreement ("License
Agreement") between you ("Licensee", either as an individual or a single entity) and
Anasoftware ("Vendor"), for the software product King Solomon Web ("Software").
The License Agreement applies to version 2.x of the Software, and overrides any previous
License Agreement. It also applies to later versions of the Software, unless overridden by
a subsequent License Agreement.
BY INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY ALL OF
THE TERMS AND CONDITIONS OF THE LICENSE AGREEMENT.
Definition. A "KSW-enabled Site" is a web/subweb on the Internet or on an Intranet,
that was developed using (among other tools) the Software.
Definition. A "Topic" is an item in the hierarchy generated by the Software on a
KSW-enabled Site, other than a folder. A Topic is defined by its filename. Items with the
same filename are considered instances of the same topic.
Definition. A "Web Component" is any file that the Software inserts in a
KSW-enabled Site.
Definition. An "Authorized Merchant" is an entity that has a valid contract with
the Vendor, based on which it is allowed to sell the Software on contract stipulated
terms.
Upon your acceptance of the terms and conditions of the License Agreement, Anasoftware
grants you the right to use the Software in the manner provided below.
If you do not accept the terms and conditions of the License Agreement, you are to
promptly delete each and any copy of the Software from your computer(s).
The Vendor reserves the right to license the same Software to other individuals or
entities under a different license agreement.
There are four types of licenses that apply to the Software:
· The King Solomon Web trial license ("Trial License")
· The King Solomon Web evaluation license ("Evaluation License")
· The King Solomon Web single user license ("Full User License")
· The King Solomon Web multi-user license ("Full Multi-User License")
The License Agreement restricts the use and installation of the Software on computers to
certain terms ("Application Licensing"), detailed bellow.
The License Agreement restricts the use and installation of the Web Components resulted
from using the Software to certain terms ("Web Licensing"), detailed bellow.
Trial License. After accepting this license agreement, if no user license was
bought, the Licensee is permitted to use the Software under the terms of this agreement,
for no more than thirty (30) days, without payment to the Vendor. In this case, the
Software will have trial restrictions activated by default, if any in effect for the
current version. The Licensee may use the Software both for trial purposes and for
publishing KSW-enabled Sites. Trial licensing mode does not require an actual license
file.
Evaluation License. An Evaluation License is provided by the Vendor to certain
entities, free of charge, for the purpose of software evaluation. The Licensee is
permitted to use the Software under the terms of this agreement, for the number of days
that a custom such Evaluation License may carry, without payment to the Vendor. In this
case, the Software will have no trial restrictions activated, running in full-featured
mode. The Licensee may use the Software for publishing KSW-enabled Sites with an unlimited
number of topics. Evaluation licensing mode does require an evaluation license file.
Full User License. If the Licensee wishes to
· use the software beyond the trial/evaluation period,
· activate all product features,
· remove the "Generated by KSW" insert,
· use the software for purposes other than trial or evaluation,
the Licensee must purchase a Full User License or a Full Multi-User License from an
Authorized Merchant. This license bears the name and email of the licensed person, and -
if applicable - the name of the entity/company. A Full User License is not transferable to
any other party. Pricing and availability is subject to change without prior notice. The
Licensee can consult the most recent pricing information at http://www.kingsolomonweb.com.
A Full User License has no time or feature limitations.
A Full User License may be used with an unlimited number of KSW-enabled Sites, subject to
the Web Licensing terms detailed bellow.
For each Full User License, the Licensee may install the Software on a single workstation
machine, except where a single user employs multiple machines, where product may be
installed on up to three machines based on a single Full User License.
Full Multi-User License. If a Full Multi-User License was bought, the Licensee may
choose to install the Software on as many machines as licenses were bought, but no more.
When the number of client machines grows, the Licensee must buy additional licenses. From
a licensing point of view, a Full Multi-User License is the equivalent of the
corresponding number of Full User Licenses.
Regardless of the number of licenses bought, the Licensee has the right to place an
additional copy of the Software and the license file on a removable medium for backup
purposes to protect the investment made. The Licensee agrees to keep the license file
(whether an Evaluation License, a Full User License, or a Full Multi-User License) in
strict privacy.
Application Licensing. A Full User License may be used on a single machine/computer
where the Software is installed, except where a single user employs multiple machines,
where product may be installed on up to three machines based on a single license. A Full
Multi-User License is the equivalent of the corresponding number of Full User Licenses.
Web Licensing. The use of the Web Components (see definition above) with a
KSW-enabled Site is subject to the following terms:
• Use of the Software and license in development of a KSW-enabled Site must comply with
the terms of this License Agreement.
• When the Software is used under a Trial License or an Evaluation License, the "Generated
by KSW" insert must not be removed from the Web Components, or modified.
No Pornography. The Web Components (see definition above) must not be used with
pornography sites.
Technical support is available directly from the Vendor at no additional charge. When
encountering problems, the Licensee must first visit the Web Site and read the information
presented there to make sure the question or problem is not already answered there. If
not, the licensee may write to the technical support email address.
The Software is provided "as is". In no event shall the Vendor or any of its affiliates be
liable for any consequential, special, incidental or indirect damages of any kind arising
out of the delivery, performance or use of this Software, to the maximum extent permitted
by applicable law. While the Software has been developed with great care, it is not
possible to warrant that the Software is error free. The Software is not designed or
intended to be used in any activity that may cause personal injury, death or any other
severe damage or loss.
The Vendor reserves the right to charge an upgrade fee in the case of major new
enhancements or additions to the Software.
You must not attempt to reverse engineer, reverse compile, modify, translate or
disassemble the Software in whole or in part. You must not run the Software under a
debugger or similar tool allowing you to inspect the inner workings of the Software.
The Software remains the exclusive property of the Vendor. Any Licensee who fully complies
with the terms in this license agreement may use it according to the terms of this license
agreement. You must not give copies of the Software or your license file to other persons
or entities. You must not transfer the Software or your license file to another person or
entity. You must also take reasonable steps to prevent any third party from copying the
software or the license file from one of your machines without your permission. These
terms equally apply to an Evaluation License, Full User License, or a Full Multi-User
License.
You may distribute the trial version of the Software that is available for public
download, on the condition that you do this by making identical copies of the downloaded
file(s). Public download means any Software file that can be downloaded by browsing
www.kingsolomonweb.com or Authorized Merchant sites, navigating through the links visible
on the page, without the use of any password or identification that you may type in or
that may be automatically supplied by your browser if you have typed it in before.
You must not ask payment for the act of distributing the trial version of the Software or
for the trial version itself. You may ask a reasonable contribution to cover your expenses
in material, shipping and communication costs. You must make it clear to the recipient
that you are sending a trial version, and that the recipient will have to accept a license
agreement, and make payment in order to fully use the Software. You must not distribute
the trial version by making it part of a larger package, unless that package is a
collection of trial software and other software that does not require payment.
All copyrights to the Software are exclusively owned by Anasoftware, except when otherwise
stated. All rights not expressly granted here are reserved by Anasoftware.
